Sweepstakes Giveaway – Official Rules, Terms & Conditions
Sponsor: Midwest Auto Sweepstakes, LLC (“Sponsor”)
Promotion: Midwest Auto Sweepstakes Giveaway (“Promotion”)
Eligible Jurisdiction for Sweepstakes Entries: Wisconsin, Michigan, Minnesota, Iowa, Indiana, Ohio, and Illinois only
1. Promotion Period
A. The Promotion may be conducted as a single promotional round or as multiple sequential promotional rounds (each, a “Round”) for a designated vehicle.
B. Specific start and end dates for each Round will be announced on Sponsor’s official website prior to the start of that Round.
C. Sponsor reserves the right to schedule additional Rounds for the same or different vehicles at its sole discretion.
2. Eligibility
A. Sweepstakes Participation
i. The Sweepstakes Promotion is open only to legal residents of Wisconsin, Michigan, Minnesota, Iowa, Indiana, Ohio, and Illinois who are at least 18 years old at the time of entry.
ii. Employees, officers, directors, agents, and representatives of Sponsor, its affiliates, and members of their immediate family or household are not eligible.
B. Merchandise Sales
i. Merchandise may be purchased by customers from all 50 states.
ii. Only purchases from the eligible states listed above will count toward sweepstakes entries and vehicle funding.
C. Void where prohibited by law.
3. How to Enter
A. Paid Entry Method
i. Eligible participants may receive entries by purchasing Sponsor’s merchandise from an eligible state through the official website during an active Round.
ii. Each one dollar (USD $1.00) paid to Sponsor equals one (1) entry.
iii. Each eligible purchase also contributes to funding the designated vehicle’s Fair Market Value (FMV) for the Round.
iv. Purchases from states outside the eligible 7 do not count as sweepstakes entries or toward FMV funding.
v. Paid entries do not represent ownership, equity, investment interest, or any enhancement of odds beyond the stated number of entries.
B. Free Alternate Method of Entry (AMOE)
i. No purchase is necessary to enter or win.
ii. Eligible participants may enter for free through Sponsor’s official website using the designated online entry form.
iii. Limit one (1) free entry per person per week per Round.
iv. Free entries require the same participant information as paid entries.
v. Free entries have the same odds of winning per entry as paid entries.
vi. Automated, duplicate, incomplete, fraudulent, or inaccurate entries are void and may result in disqualification.
4. Winner Selection
A. Selection Method
i. One (1) potential winner will be selected at random from all eligible entries received during the applicable Round.
ii. Winner selection may be conducted using automated or software-assisted systems; Sponsor retains final authority.
iii. Odds of winning depend on the total number of eligible entries received.
B. Notification
i. Potential winners will be notified by email within five (5) business days following the drawing.
ii. Failure to respond within seven (7) days of notification may result in forfeiture and selection of an alternate winner.
5. Prize Description and Fair Market Value – Funding-Adjusted Structure
A. Designated Vehicle / FMV
i. Each Round will have a designated vehicle with a pre-determined Fair Market Value (FMV) displayed on the website before the Round begins.
B. Prize Funding & Eligibility
i. If total revenue from eligible merchandise purchases meets or exceeds the FMV:
1. The winner may choose the designated vehicle.
2. The winner may choose a cash prize equal to the FMV.
ii. If total revenue from eligible merchandise purchases does not meet the FMV:
1. The winner will receive a pre-disclosed percentage of the total revenue raised during the Round.
2. The percentage awarded will be clearly disclosed on the website prior to the start of the Round.
C. FMV Determination
i. FMV is determined in good faith using nationally recognized vehicle valuation sources, which may include Kelley Blue Book (KBB), NADA Guides (J.D. Power), Edmunds True Market Value (TMV), and dealership pricing or invoice documentation.
ii. FMV is fixed and displayed publicly before the Round begins.
iii. Sponsor’s FMV determination is final and binding.
D. Cash Alternative / Shortfall
i. In the event the Round does not reach the FMV through eligible merchandise sales, the winner cannot receive the vehicle and will instead receive the pre-disclosed percentage of total revenue.
ii. All winners will be notified of the prize amount in accordance with Section 4.
6. Taxes and Expenses
A. Responsibility
i. Winners are solely responsible for all federal, state, and local taxes associated with acceptance or receipt of any prize.
ii. The value of the prize for tax reporting purposes shall be the actual cash amount awarded or the FMV of the vehicle, as applicable.
B. Documentation
i. Sponsor may require completion of IRS Form W-9 and may issue IRS Form 1099-MISC or equivalent documentation as required by law.
ii. Failure to provide required documentation may result in forfeiture and selection of an alternate winner.
C. Vehicle Expenses
i. If the vehicle is selected, the winner is responsible for title, registration, insurance, and all other vehicle-related expenses.
7. Vehicle Delivery
A. Logistics
i. Sponsor will arrange vehicle delivery at no expense to the participant.
ii. Delivery logistics and timing are determined by Sponsor.
B. Eligibility
i. Vehicle delivery is available only within the eligible states listed in Section 2.
8. Vehicle Condition and Mileage Disclaimer
A. All vehicles are used and awarded “AS IS, WHERE IS.”
B. Sponsor makes no warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose.
C. Vehicle mileage may increase due to transportation, testing, or maintenance and does not constitute a material change.
9. Privacy
A. Sponsor collects and uses participant information solely for:
i. Administering the Promotion.
ii. Verifying eligibility.
iii. Awarding prizes.
iv. Complying with legal obligations.
v. Internal recordkeeping.
B. Personal information will not be sold and will be disclosed only to service providers or authorities as required to operate the Promotion or comply with applicable law.
10. Publicity
A. Except where prohibited by law, acceptance of a prize constitutes the winner’s consent to Sponsor’s use of the winner’s name, city, and likeness for advertising and promotional purposes without additional compensation.
11. General Conditions
A. Decisions
i. Sponsor’s decisions are final and binding in all matters relating to the Promotion.
B. Entries
i. Entries are non-transferable and have no cash value outside the Promotion.
C. Disqualification
i. Sponsor reserves the right to disqualify any participant who violates these Official Rules or engages in fraud, abuse, or misconduct.
D. Cancellation
i. Sponsor may cancel, suspend, or modify the Promotion if circumstances beyond Sponsor’s control compromise the integrity of the Promotion.
12. No Lottery or Gambling
A. This Promotion is a sweepstakes and not gambling or a lottery.
B. No purchase is required to enter or win.
C. Paid entries from eligible states only do not improve odds per entry compared to free entries.
13. Limitation of Liability
A. To the fullest extent permitted by law, Sponsor’s total liability arising out of or relating to the Promotion shall not exceed the total amount paid by the participant, if any, during the applicable Round.
14. Governing Law and Venue
A. This Promotion is governed by the laws of the State of Wisconsin.
B. All disputes shall be resolved exclusively in the state or federal courts located within the State of Wisconsin.
15. Compliance Audit and Legal Review
A. Sponsor conducts periodic internal compliance audits and legal reviews of its sweepstakes operations to promote adherence to applicable federal and state laws.
B. Such reviews do not create additional rights for participants beyond those expressly stated herein.
16. Financial Documentation and Recordkeeping
A. Sponsor maintains detailed financial and transactional records for each Round, including:
i. Entry totals.
ii. FMV determinations.
iii. Funding amounts.
iv. Winner selection data.
v. Prize fulfillment documentation.
B. Records may be disclosed to regulatory authorities as required by law.
APPENDIX A — WINNER AFFIDAVIT & RELEASE (SUMMARY)
A. Winners may be required to affirm:
i. Eligibility.
ii. Compliance with these Official Rules.
iii. Acceptance of the prize as taxable income.
iv. Release of Midwest Auto Sweepstakes, LLC from liability.
